PROMOTION TERMS & CONDITIONS

Please read these Promotion terms and conditions ("Terms and Conditions") carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate in this Promotion.

All participants during the term of this Promotion agree to be bound by the following terms and conditions:

1. Promotion Validity:

Valid only from 1 November to 31 December 2024 in participating stores in South Africa. The duration of the Promotion may be extended or curtailed at the discretion of the Versuni South Africa (Pty) Limited (“Organizer”).

2. Eligibility Requirement:

All participants must be a natural person and be at least 18 (eighteen) years old at the date of the commencement of the promotion period and have a valid purchased a Philips 2000 Series Airfryer (NA231) from participating Shoprite Checkers or Hirsch’s Stores in South Africa nationwide as set out in this Terms & Conditions.

3. Eligible Product:

Applicable exclusively to Philips 2000 Series Airfryer (NA231)

4. Prize Details:

Upon purchase of the Philips 2000 Series Airfryer (NA231), participants will receive a R200 (Two hundred Rand) Instore Voucher that can be redeemed immediately to receive a discount on the retail price or kept to be redeemed at another point in time. The voucher is only redeemable on products from Shoprite Checkers or Hirsch's Stores. The voucher must be used within 3 months following the purchase, if not redeemed immediately.

5. Participating Store:

This promotion is valid only at participating Shoprite Checkers or Hirsch’s Stores in South Africa nationwide. It cannot be redeemed at non-participating stores or through unauthorized sellers, including online marketplaces unless specifically listed as part of this promotion.

6. Voucher Redemption:

Can only be used on the next purchase, not exchangeable for cash.

7. Promotion End:

31 December 2024 or while stocks lasts.

8. Voucher Validity:

3 (Three) Months from purchase

9. Limitations:

One voucher per purchase, non-combinable with others.

10. Non-Transferable:

Only the original recipient can use the voucher.

11. Right to Amend:

Organizer reserves the right to modify, cancel, or suspend the Promotion without prior notice.

12. Proof of Purchase:

Receipt may be required to redeem the voucher.

13. Additional Conditions:

Return of the original item voids the voucher, which may affect refunds.

14. Disclaimer:

Organizer is not responsible for any lost, stolen or damaged vouchers and shall not be liable for any inability to redeem a voucher due to circumstances beyond its control, including but not limited to stock availability, store participation, or technical issues.

15. Consumer Protection Act:

Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for the participant in terms of the Consumer Protection Act, 68 of 2008 ("CPA"). By entering the Promotion in accordance with its terms, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA.

16. Limitation of Liability:

To the extent permitted by Consumer Protection Act and any other applicable law:

a. The participant hereby indemnifies the Organizer against any direct, indirect, special, incidental, consequential, or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise because of the participant's entrance to the Promotion.

b. The Organizer excludes all warranties (express or implied), representations, and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).

17. General:

a. By entering and participating in the promotion, participants agree that the Organizer may collect and process their personal information, which includes name, mobile and number, for purposes of this promotion. Participants have the right to withdraw their consent at any time. However, withdrawing consent may result in disqualification from the draw and forfeiture of the opportunity to win a prize.

b. Participants undertake that the personal information they provide is valid and correct throughout the campaign period.

c. The Organizer reserves the right, at any time, to verify the validity of entries and Participants and to disqualify any participants who submit an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

d. In accordance with the confidentiality policies and practices of the Organizer, none of the entry details of any participant in this Promotion will be disclosed or used by the Organizer for any purposes other than as required by the Promotion.

e. In the event of a dispute, the decision of the Organizer will be final and binding, and no correspondence will be entered into regarding such disputes. The Organizer reserves the right to handle any disputes or failure to adhere to the rules at its sole discretion, including the right to immediately disqualify entrants from this promotion.

f. Organizer will not be held liable for failure to conduct the promotion as planned due to causes beyond its reasonable control, such as natural disasters or other emergencies.

g. Any dispute or claim arising out of or in connection with the Promotion shall be governed by and construed in accordance with the laws of South Africa.
